D.C. Circuit Blocks DHS Push To Expand Expedited Removals Nationwide

A D.C. Circuit panel declined to stay a lower-court injunction blocking the Trump administration’s nationwide expansion of expedited removal, finding the government unlikely to show its procedures adequately protect migrants’ Fifth Amendment due-process rights. The court cited serious risks of erroneous summary removals if fast-track deportations extend beyond the border and largely left Judge Jia Cobb’s order intact, narrowing only parts affecting credible-fear determinations. Judge Neomi Rao dissented. Arguments on the merits are set for Dec. 9.
