FEDERAL JUDGE HALTS ICE WARRANTLESS ARRESTS STATEWIDE IN COLORADO

A federal judge in Denver issued a preliminary injunction finding ICE’s warrantless arrest practices in Colorado unlawful and restricting how officers may make arrests. The order requires pre-arrest probable-cause and flight-risk determinations (with documentation), repayment of bond money and removal of ankle monitors for the named plaintiffs, and classwide relief for people arrested in Colorado since Jan. 20, 2025. ICE must regularly provide probable-cause forms to plaintiffs’ lawyers and is barred from rearresting the plaintiffs without a judicial warrant absent a material change. Plaintiffs, represented by the ACLU and local firms, alleged indiscriminate arrests based on skin color, accent, or perceived nationality.
